PED DIRECTIVE AND D.M. 329/2004 – ANNEX VII Legislative Decree 81/08

Directive 97/23/EC (PED) on pressure equipment is replaced by the new Directive 2014/68/EU aligned to the new European legislative scenario.

SECTOR REGULATORY SCHEME:

  • CONSTRUCTION OR MODIFICATION PHASE to which Directives 2014/68/EU (PED) and 2014/29/EU (SPV) refer.
  • PHASE OF COMMISSIONING, USE AND REPAIR referred to in the D.M. 329/2004 and Legislative Decree 81/2008 and subsequent amendments;

Pressure equipment is classified by the PED Directive, based on their type (container, piping, steam generator) and the dangerousness of the fluid contained, in four categories, from I to IV, characterized by different and increasing risk degrees based on to the following parameters:

  • Maximum Allowable Pressure (PS);
  • Maximum Allowable Temperature (TS);
  • Volume (V);
  • Nominal diameter (DN) (for pipes).

The Ministerial Decree 329/2004 provides for a process of notification and control of the pressure equipment in its entirety, starting from the verification of commissioning, continuing with the declaration or declaration of commissioning to arrive at the periodic checks; finally the repairs and modifications of the equipment are contemplated according to the categories.

It is mandatory for the user who has installed equipment, a pipe or a pressure assembly falling within the field of application of the legislation, to declare their commissioning before using them (art.6 DM 329/04). This declaration must be communicated to the territorially competent INAIL through the appropriate CIVA portal.
